Terms & Conditions
MISSION FITNESS UK GYM LTD – TERMS & CONDITIONS
1. Definitions​
​
1.1 The Club: Mission Fitness UK Gym Ltd (“Mission Fitness UK”, “we”, “us”, “our”).
1.2 The Club Rules: The rules and regulations of the Club, as amended from time to time. These are available in the ClubRight App (menu tab) and on our website: https://www.missionfitnessuk.com/gym-rules
1.3 Commitment Period: The minimum membership term starting from your Start Date and ending at the end of the agreed Commitment Period (subject to extension if membership is frozen).
2. Membership​

2.1 By joining the Club, you agree to comply with these Terms & Conditions and the Club Rules.
2.2 Members are required to actively acknowledge and accept these Terms & Conditions:
• Online via the ClubRight App during the sign-up process, or
• In person, where staff brief members and mark acknowledgment, with their agreement, in the member profile.
2.3 You may only use the Club facilities when your membership is active and all payments are up to date or acceptable arrangements have been agreed.
2.4 Duplicate Accounts
If a member creates multiple ClubRight accounts, the Club may merge accounts and recover any unpaid fees under any account linked to the member’s details.
2.5 Accuracy of Information
Members must provide accurate information. Providing false or inaccurate personal data may result in the suspension or termination of a membership under Clause 7.1.
3. Duration​
​
3.1 By joining, you agree to remain a member for the full Commitment Period.
3.2 For monthly memberships, your membership continues automatically after the Commitment Period unless cancelled under Clause 7.2.
3.3 For prepaid memberships, your membership ends automatically at the end of the prepaid period unless renewed.
4. Fees & Payment​
​
4.1 Membership fees are determined by membership type and category.
4.2 Joining fees may apply.
4.3 Prices for goods and services may change from time to time.

4.4 Price Reviews
​
We may adjust membership fees with at least 30 days’ notice. No increases apply within an active Commitment Period. Updated fees apply automatically once the notice period has passed unless the member cancels in accordance with these Terms.

4.5 Failed Direct Debit Payments & Membership Access​
​
If a Direct Debit fails, ClubRight will automatically retry the payment a minimum of three times.
During this period:
• The account will show as “overdue”, and
• Gym access will be suspended.
If all retry attempts fail:
a) Payment can be made via Stripe in the ClubRight App, in person, or by phone.
b) If the Direct Debit provider later collects a retry payment, members must not make a manual payment to avoid duplicated charges.
c) Members must check the ClubRight App or their bank before making an alternate payment.
Access to the gym reinstates automatically when the payment has cleared.

4.6 If fees remain unpaid for 30 days, the full remaining balance of the Commitment Period becomes due immediately.
​
4.7 Overdue accounts referred for collection may incur a surcharge of up to £30 plus recovery costs.

4.8 Cancelling Direct Debit Early​
​
Cancelling your Direct Debit does not cancel your membership. If cancelled before the required notice period is served, overdue charges may be reinstated and remain payable.

4.9 Direct Debit Cancellation Without Valid Notice
​
If a member cancels their Direct Debit instruction without providing valid written notice to terminate their membership in accordance with Clause 7, the membership agreement remains in force and all fees remain payable.
Where a Direct Debit has been cancelled and a payment is due:
a) The Club reserves the right to collect the outstanding or final payment using the stored debit or credit card on the member’s membership account via Stripe or another approved payment processor.
b) This collection may be initiated by the Club and may include any outstanding arrears and/or the final payment required to complete the notice period.
c) Members are responsible for ensuring their stored card details remain valid and up to date.
d) Failure to maintain valid payment details does not remove the member’s obligation to pay fees due under these Terms & Conditions.
Any unpaid balance remaining after attempted collection may be treated as overdue and dealt with in accordance with Clauses 4.6 and 4.7.

5. Member Referral / Rewards
​
Referral benefits apply only once the referred member has successfully paid their first Direct Debit. Both memberships must remain active.

6. Freezing a Membership​
​
6.1 Memberships may be frozen for medical reasons only for 1–3 continuous months.
6.2 No fee applies for freezing.
6.3 A minimum of 10 days’ notice is required; medical evidence may be requested.
6.4 Freezing during the Commitment Period extends the Commitment Period.
6.5 Cancellation notice cannot run during a freeze.

7. Termination​
​
7.1 Termination by the Club​
​
We may terminate your membership if:
a) You seriously or repeatedly breach these Terms or Club Rules and fail to remedy this within 7 days;
b) Fees remain unpaid 30 days after the due date;
c) You provided false information during signup that affected our decision to grant membership.

7.2 Termination by You​
​
You may terminate your membership:
a) After the Commitment Period, by giving 1 full calendar months’ notice from your payment date.
Example: Payment date = 9th. Notice on 10th → final payment next month on the 9th → membership ends one month after that payment.
b) Cancelling your Direct Debit does not constitute notice.
c) You may cancel with 1 months’ notice for long-term illness/injury (6+ months) with evidence.
d) You may cancel if:
• facilities or hours are permanently reduced.
• the Club relocates.
• the Club closes for refurbishment for more than 30 consecutive days.

7.3 Written Notice Only​
​
All cancellation notices must be in writing via email, or the ClubRight App. Verbal cancellations are not valid.
​
7.4 Notice Cannot Be Backdated​
​
The notice period begins only when written notice is received. It cannot be backdated.
​
7.5 Non-Use of Membership​
​
Non-use of the facilities does not constitute cancellation and does not exempt members from paying fees. Fees remain payable until written notice is given, and the notice period is completed.

8. Access Control (24/7 Facility)​
​
8.1 Members receive a personal QR code and PIN for entry.
8.2 QR codes and PINs are strictly non-transferable. Misuse may result in termination.
8.3 Tailgating or allowing unauthorised entry is prohibited and may result in termination.
8.4 Members must ensure the entry door closes securely behind them.

8.5 24/7 Unstaffed Hours Safety & Risk Acknowledgment
​
Members acknowledge:
• Staff are not present 24/7.
• They use the facility during unstaffed hours entirely at their own risk.
• They must follow displayed safety instructions.
• Emergency systems must be used only when required.

9. Club Rules & Additional Policies
​
9.1 Children & Pets
​
• No children under 15 permitted on site.
• No pets except approved assistance dogs are allowed on site.
​
9.2 Behaviour & Conduct
​
Respectful behaviour is required at all times. Abuse toward staff or members may result in suspension or termination.
​
9.3 Filming & Photography​
​
• No filming or photography of others without explicit permission.
• No filming or photography at any times in toilets or changing areas.
• Misuse of recordings may result in termination.
​
9.4 Equipment Misuse & Damage
​
Members must use equipment safely. Damage caused by negligence and misuse may be chargeable.
​
9.5 Damage & Cleaning Fees​
​
The Club may charge reasonable fees for damage, excessive cleaning, or costs resulting from misuse or breach of Club Rules.
​
9.6 CCTV
​
The Club uses CCTV for safety, security, and compliance. It is not monitored live at all times.
​
9.7 Health Screening​
​
Members confirm they are fit to exercise and must inform the Club of any health changes. A PAR-Q or similar form must be completed before using the Club facilities.
​
10. Limitation of Liability
​
10.1 The Club is not liable for loss, theft, or damage of personal belongings. Items stored in lockers are at the owner’s risk.
10.2 For loss or damage (other than death or personal injury) caused by the Club’s negligence, liability is limited to a reasonable amount.
10.3 The Club is not liable for incidents resulting from:
a) Your own actions.
b) Third parties unconnected with our services.
c) Events beyond our control.
10.4 Members accept they use the Club at their own risk, including during unstaffed hours.

11. Health & Safety​
​
Members must follow all safety notices and instructions. Members acknowledge the risks associated with exercise and confirm they are fit and healthy to use the facilities.
​
12. Sale of the Club​
​
If ownership changes, memberships may transfer to the new owner unless terms materially change.
13. Notices
​
Member notices must be provided in writing via email or letter.
Club notices may be sent via email, the ClubRight App, or displayed within the Club.
​
13.1 Verbal Notice Not Valid
Verbal requests are not acceptable as formal notice.
14. Governing Law & Jurisdiction
​
These Terms are governed by the laws of England and Wales. Disputes fall under the jurisdiction of the courts of England and Wales.
15. Severability
​
If any provision is deemed invalid or unenforceable, the remaining provisions remain in full force.
16. Amendments
​
The Club may amend these Terms at any time. Members will be notified via the ClubRight App or website. Continued use of the Club constitutes acceptance.
​
16.1 App and Website Updates Binding
​
Updates posted in the ClubRight App or on the website are considered formally communicated and binding.
17. Privacy & Data​
​
Member data is processed according to the Club’s Privacy Policy, including data used for access control, payments, CCTV, and ClubRight App operation.
18. Emergency Procedures
​
The Club provides emergency alarms, exits, and first aid equipment. Members must familiarise themselves with emergency procedures and act responsibly.
19. Application Declaration
​
I confirm that the information I have provided is correct and apply for membership under these Terms & Conditions. I understand and acknowledge:
i) My membership continues automatically after the Commitment Period unless I give 1 full calendar month’s notice from my payment date.
ii) I may request a medical freeze for 1–3 months with 10 days’ notice; freezing extends the Commitment Period.
iii) I agree to pay all fees for the full Commitment Period.
iv) I have received a personal QR code and PIN and will not share them.
v) I will comply with all Club Rules and understand failure to do so may result in suspension or termination.
vi) I authorise the Club to collect any fees lawfully due under these Terms & Conditions using my stored debit or credit card details on my membership account (including via Stripe or another approved payment processor), where payment remains outstanding or where a Direct Debit has been cancelled without valid notice being given.
